FILA Rewards: Member Terms & Conditions

GENERAL TERMS

1. By applying to join the FILA Rewards Loyalty Program, You agree to be bound by these Member Terms and Conditions.
2. You waive any rights you have or may have against FILA for or in connection with any damage sustained to computers resulting from one or more Technical Issues.
3. FILA may amend the Member Terms and Conditions (including by modifying the FILA Rewards Loyalty Program and changing the parameters of the Reward tiers) at any time by notice in writing to You, which you agree may be by the posting of that notice on www.fila.com.au/rewards. Any changes to the Member Terms and Conditions apply on and from the later of the date of the notice effecting the change and any other date specified in that notice.
4. FILA may transfer You to another loyalty program owned, operated, managed, or administered by FILA, its related bodies corporate, or associated entities (as those terms are defined in the Corporations Act 2001 (Cth)).
5. These Member Terms and Conditions should be read in conjunction with any additional conditions associated with the Website Terms and Conditions, Terms Of Sale and Privacy Policy.
6. In these Member Terms and Conditions, a 'day' refers to a 24-hour period ending at 11.59 pm AEST/AEDT.
7. Any failure or delay by FILA in exercising its rights under these terms does not constitute a waiver of those rights. A waiver by FILA operates as a waiver only if in writing and signed by an authorised officer of FILA.
8. If any provision in these Member Terms and Conditions is found to be invalid, illegal or unenforceable, it shall be read down to be valid, lawful and enforceable, and otherwise severed to the extent of any invalidity, illegality or unenforceability, without affecting the remaining provisions of these Member Terms and Conditions.

MEMBERSHIP

1. Membership in the FILA Rewards Loyalty Program is open to any natural person aged 18 years or older.
2. Membership commences on the Join Date. The Join Date is the date on which the applicant signs up to the FILA Rewards Loyalty Program in-store or online.
3. You acknowledge that communications about the FILA Rewards Loyalty Program will generally be by email. You acknowledge further that You will receive those communications only if Your email address is correct and current and the FILA URL is quarantined as safe in Your email settings.
4. If requested in writing, You must provide proof of identification (in the form requested by FILA) to verify membership authenticity and compliance with the Member Terms and Conditions. Failure to provide proof of identification may result in suspension of Your membership in the FILA Rewards Loyalty Program.
5. You are entitled to the Rewards associated with the Reward Tier to which You are assigned. Upon signing up, You will be classed in the Bronze Reward Tier, upon spending $500 or more
in 12 months, You will go into the Silver Reward Tier, and upon spending $1000 or more in 12 months, You will go into the Gold Reward Tier. Failure to spend the same amount or more within 12 months of moving up a tier, You will go down to the lower tier (for example, Gold moves to Silver, Silver moves to Bronze).
6. You may only have one account (Primary Account) within the FILA Rewards Loyalty Program. Purchases of goods recorded on any account other than Your Primary Account are not Valid Purchases and You are not entitled to Rewards for those purchases.
7. All Rewards have an expiry date listed with the Reward, at which point they will no longer be available for redemption. FILA Reward expiry is determined by the Rewards Tier You are classed in, Bronze Rewards expire after 30 days, Silver Rewards expire after 60 days and Gold Rewards expire after 90 days.
8. Account and Rewards transfers to other individuals are not permitted.
9. FILA retains the right to modify, refuse, or terminate a Member's account in the FILA Rewards Loyalty Program if it suspects on reasonable grounds misuse or creation of multiple accounts in order to obtain more Rewards.
10. You have the option to end Your membership at any time by contacting FILA’s Customer Service team at 1800 000 339 or through email at info@fila.com.au.

EARNING FILA REWARDS

1. The value of each Valid Purchase of FILA branded goods completed is added to Your Spend Balance if You identify yourself as a Member in-store by providing the email registered to your account, identifying yourself (including by presenting photo identification) or online by logging into their online Member account.
2. Rewards will be issued within 48 hours of store purchases and within 48 hours of online orders being dispatched (not made).
3. All Rewards are recorded in and valued at AUD.
4. FILA reserves the right to withdraw or cancel Rewards points and/or vouchers without notice and at any time if there is evidence of administration errors, system errors, technical issues or similar events which are out of FILA’s control.
5. Rewards cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including gift vouchers, gift cards, cheques and credit notes. Rewards do not represent legal tender in any country.
6. If a Membership is terminated from the FILA Rewards Loyalty Program, all outstanding and future Rewards will no longer be valid and will be rendered void.
7. Only one transaction Reward will be earned and uploaded to a Member’s FILA Rewards Loyalty Card per day.
8. Rewards can be earned from Valid Purchases using AfterPay, Klarna, ZIP or PayPal purchase.

REDEMPTION OF REWARDS

1. Rewards can be redeemed at all FILA stores in Australia and on the Website in Australia only (excluding the signup discount of 10%, which can only be redeemed on the Website). Rewards cannot be redeemed through FILA resellers, including Target, Harris Scarfe, Costco, City Beach, JD Sports, INSPORT or Factory stores or through any online marketplaces including Amazon, eBay, Kogan, Catch, The Iconic or OzSale.
2. To redeem any applicable Reward when transacting online on the Website, You must ensure You are logged into a valid account.
3. The FILA Website and online store is based in Australia and consequently, will redeem Rewards in AUD.
4. When redeeming any Reward, the Reward will be applied proportionally across each item purchased, based on the percentage each item represents of your total purchase. This will mean that the Reward will not be split equally across all items.
5. Rewards cannot be redeemed in conjunction with any other offer unless otherwise indicated.
6. Rewards cannot be redeemed against gift card purchases or shipping costs.
7. Rewards can be redeemed as payment for purchases using a Buy Now Pay Later provider (such as Afterpay, ZIP, PayPal or Klarna) at the time of purchasing before the first payment takes place.
8. FILA will not be held responsible or liable if Rewards are not able to be redeemed for whatever reason but specifically, in the case of a Technical Issue including without limitation the failure of software or hardware or an EFTPOS malfunction.
9. Rewards can only be redeemed once.
10. FILA reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Rewards.
11. Returns: If a customer wishes to return a purchase for any reason, Rewards earned on that purchase (including the promotion to a higher Rewards tier, and any tier-based rewards) will be reversed.
12. Exchanges: If a customer wishes to exchange goods in-store or online, Rewards points will be added or deducted depending on the price variation. If the exchange value is less, Rewards earned on that amount (including the promotion to a higher Rewards tier, and any tier- based rewards) will be reversed.

PRIVACY

1. FILA may collect personal information from You, in respect of which FILA’s Privacy Policy applies, Privacy Policy.
2. The purposes for which that information is collected include facilitating Your participation in the FILA Rewards Loyalty Program and promoting FILA products to You that FILA believes may be of interest to You.
3. You consent to the collection and use of your personal information for these purposes and acknowledge that You cannot participate in the FILA Rewards Loyalty Program unless that consent is forthcoming.

DEFINITIONS

Anniversary means the anniversary of a Member's Join Date or the date that Member changed Reward Tiers, whichever date is the later.
Effective Date the date which a customer is added to a Rewards Tier;
Join Date means the date provided for in clause 2 .
Member Terms & Conditions means this document, as amended from time to time.
FILA means FILA AUSTRALIA PTY LTD ABN 73 601 567 211, its related entities and its authorised representatives.
FILA Rewards Loyalty Program means the loyalty program operated by FILA under which members of that program are entitled to Rewards in accordance with these Member Terms and Conditions.
Rewards means rewards or other benefits to which members are entitled as a consequence of purchasing goods from FILA.
12 Month Spend Balance means Your Spend Balance in the 12-month period beginning on the Effective Date or any anniversary of the Effective Date.
Spend Balance means a Member’s net cumulative spend after all discounts, returns, promotional or gift items are deducted on Valid Purchases.
Technical Issues means the malfunction of any telephone network, connection or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.
Valid Purchases means all purchases of FILA branded goods completed at FILA stores and on the Website within Australia (other than purchases effected by the redemption of Rewards, or gift cards), the value of which being the invoice price less delivery costs. Any purchases which are returned will not constitute Valid Purchases. Purchases of FILA merchandise from FILA resellers, including Target, Harris Scarfe, Costco, City Beach, JD Sports, INSPORT or Factory stores or through any online marketplaces including Amazon, eBay, Kogan, Catch, The Iconic or OzSale are not Valid Purchases.
Website means the FILA website at fila.com.au.

TIERS & ASSOCIATED REWARDS

GENERAL

1. Members are allocated to tiers on the basis of their Spend Balance (Member Status) in the following manner and as depicted below:
Gold Member Status: members whose Spend Balance is $1000 or more; Silver Member Status: Members whose Spend Balance is $500 or more, but less than $1000; Bronze Member Status: Members whose Spend Balance is less than $500.
2. On Your Anniversary, Your status will be determined by Your 12 Month Spend Balance and You will, depending on Your 12 Month Spend Balance, either retain Your Member Status or be moved down to a different Reward Tier. Your status will then remain in that Reward Tier until the next Anniversary unless Your 12 Month Spend Balance qualifies You to move to a higher Reward Tier.
3. If at any time Your status changes, resulting in You changing Reward Tiers, Your Tier Spend Balance reverts to zero dollars. Your 12 Month Spend Balance from the previous Reward Tier does not carry over to Your new 12 Month Spend Balance.

BRONZE STATUS

1. All Bronze status Rewards will expire 30 days after issue unless otherwise indicated.
2. Free standard shipping online for all orders over $130. The free shipping benefit is available for shipping within Australia only. Free Shipping cannot be used in conjunction with any other offer unless otherwise indicated.
3. 10% Discount Reward when they sign up to FILA Rewards Loyalty Program. Once Account has been created, members can login at checkout and discount can be applied. Limit of one use per customer, per order. Cannot be used in conjunction with any other offer. Discount can only be redeemed online (www.fila.com.au).
4. $10 Birthday Reward: A $10 ‘Birthday Reward’is issued to qualified BRONZE STATUS members, once every 12 months, on or within the 3 days following your birthday (You must have entered a valid date of birth in the relevant section of their Member Profile prior to their birthday in order to receive this Reward). You will receive an email with how to redeem the discount within 48 hours of the birthday reward being issued to you. The Birthday Reward expires 30 days after date of issue. $20 minimum spend applies. Limit of one use per customer, per order. Cannot be used in conjunction with any other offer. Can be redeemed online (www.fila.com.au) or any FILA store Australia-wide.
5. Exclusive Previews: access to the latest collections, promotions and sales offers via Member Emails.
6. Eligible for invitations to in store events.

SILVER STATUS

1. All Silver status Rewards which will expire 60 days after issue unless otherwise indicated.
2. $20 ‘Welcome Reward’: issued every time You change tier to Silver Member status which expires 60 days after date of issue. Member must spend between $500 and $999 within a 12-month period. You will receive an email with how to redeem the discount within 48 hours of You qualifying for Silver Status. Limit of one use per customer, per order. Cannot be used in conjunction with any other offer. Can be redeemed online (www.fila.com.au) or any FILA store Australia-wide.
3. $20 Birthday Reward: A $20 Birthday Reward is issued to qualified SILVER STATUS members, once every 12 months, on or within the 3 days following your birthday (You must have entered a valid date of birth in the relevant section of their Member Profile prior to their birthday in order to receive this Reward). You will receive an email with how to redeem the discount within 48 hours of the birthday reward being issued to you. The Birthday Reward expires 60 days after date of issue. $40 minimum spend applies. Limit of one use per customer, per order. Cannot be used in conjunction with any other offer. Can be redeemed online (www.fila.com.au) or any FILA store Australia-wide.

You will receive an email with how to redeem the discount within 48 hours of You qualifying for Gold Status. Limit of one use per customer, per order. Cannot be used in conjunction with any other offer. Can be redeemed online (www.fila.com.au) or any FILA store Australia-wide.
3. A $50 ‘Birthday Gift Reward’: A $50 Birthday Reward is issued to qualified GOLD STATUS members, once every 12 months, on or within the 3 days following your birthday (You must have entered a valid date of birth in the relevant section of their Member Profile prior to their birthday in order to receive this Reward). You will receive an email with how to redeem the discount within 48 hours of the birthday reward being issued to you.
